1. About SangmarmarDekho

SangmarmarDekho operates as an online marketplace connecting buyers and sellers.

The Platform may provide:

• Seller/company profiles
• Product listings
• Product images and videos
• Search and discovery
• Location-based product discovery
• Buyer enquiries
• Seller enquiry management
• Email notifications
• WhatsApp connectivity where available
• Seller dashboards
• Product and seller analytics
• Premium Seller visibility
• Featured seller/product placement
• Digital catalogues
• Other marketplace features

SangmarmarDekho is a marketplace and technology platform.

Unless expressly stated otherwise, SangmarmarDekho does not itself manufacture, own, stock, sell, purchase, inspect, transport or deliver products listed by sellers.

Any commercial transaction for products or services is generally between the buyer and seller.

2. Eligibility

You must be legally capable of entering into a binding agreement under applicable law.

If you register on behalf of a company, firm or other organisation, you confirm that you have authority to act on behalf of that organisation.

3. Buyer Accounts and Enquiries

Buyers may use SangmarmarDekho to:

• Search for products;
• Discover sellers;
• View business profiles;
• Submit enquiries;
• Contact sellers;
• Use available communication options.

When a buyer submits an enquiry, relevant information may be shared with the selected seller so that the seller can respond.

Buyers are responsible for providing accurate contact and enquiry information.

4. Seller Accounts

Sellers may create a business profile and list products subject to our verification and approval processes.

Sellers are responsible for providing accurate and current information relating to:

• Business name;
• Business type;
• Address;
• Contact information;
• Products;
• Product specifications;
• Product images;
• Product videos;
• Availability;
• Pricing where displayed;
• Product quality;
• Delivery terms;
• Warranty or guarantee;
• Other information supplied by the seller.

5. Seller Verification

SangmarmarDekho may verify seller information through:

• Mobile verification;
• Email verification;
• Business information;
• Documents;
• GST information where applicable;
• Other reasonable verification methods.

A Verified Seller or similar designation only means that SangmarmarDekho has completed the applicable verification process.

Verification is not a guarantee or certification of:

• Product quality;
• Product authenticity;
• Financial standing;
• Seller performance;
• Delivery;
• Warranty;
• Future transactions.

6. Product Listings

Sellers must ensure that product listings are accurate and lawful.

Sellers must not:

• Upload fraudulent information;
• Misrepresent products;
• Upload stolen images;
• Use another company's identity;
• Manipulate product views;
• Create fake enquiries;
• Manipulate reviews;
• Mislead buyers regarding product origin;
• Publish prohibited or unlawful products;
• Spam buyers.

Natural stone products may naturally vary in colour, shade, pattern, veining, texture and finish. Online images may therefore not exactly represent the physical product.

Buyers should confirm samples, specifications, quality, quantity, price and other commercial conditions directly with the seller before purchasing.

7. Marketplace Transactions

SangmarmarDekho does not guarantee that a buyer and seller will complete a transaction.

SangmarmarDekho does not guarantee:

• Product quality;
• Product availability;
• Prices;
• Delivery;
• Installation;
• Seller performance;
• Buyer performance;
• Payment by another user;
• Number of enquiries;
• Number of sales;
• Revenue;
• Business results.

Buyers and sellers are responsible for conducting appropriate due diligence before entering into a commercial transaction.

8. Seller Subscription Plans

SangmarmarDekho may offer paid subscription plans and services, including Business Seller, Premium Seller and other plans introduced from time to time.

The applicable price, duration and features will be displayed at the time of purchase.

Seller services may include:

• Business profile;
• Product listings;
• Product visibility;
• Seller dashboard;
• Enquiry management;
• Analytics;
• Catalogue services;
• Premium display;
• Featured placement;
• WhatsApp connectivity;
• Other promotional features.

Features may vary according to the subscription purchased.

9. Premium Seller and Featured Visibility

Premium Seller or Featured services may provide additional visibility to participating sellers or products.

Such placement may influence where or how a seller or product appears on the Platform.

However, Premium or Featured status does not guarantee:

• A specific search position;
• A specific number of views;
• A specific number of enquiries;
• Sales;
• Orders;
• Revenue.

Paid promotional visibility is separate from organic marketplace ranking.

10. Marketplace Ranking and Discovery

SangmarmarDekho may use different factors to determine how products and sellers are displayed.

Stones Near You

Products may be displayed based on factors including:

• Buyer's selected location;
• Seller/product location;
• Geographic distance;
• Product relevance;
• Availability;
• Other marketplace factors.

Trending

Trending products may be determined using marketplace activity such as:

• Product views;
• Buyer enquiries;
• Recent engagement;
• Popularity;
• Freshness;
• Other activity signals.

Trending does not mean that a product is better, cheaper or higher quality.

Premium / Featured

Paid Premium or Featured services may provide additional visibility.

SangmarmarDekho may modify ranking and discovery mechanisms from time to time to improve the Platform.

11. Subscription Payment

Paid services may be purchased through Razorpay or another payment service provider made available by SangmarmarDekho.

Payment processing is performed through the applicable payment provider's systems and is subject to its applicable terms.

Razorpay provides payment and subscription infrastructure, including recurring-payment functionality where enabled.

SangmarmarDekho generally does not store complete card numbers or CVV information on its servers.

12. Subscription Renewal and Cancellation

Where recurring billing is enabled, the subscription may renew automatically according to the selected billing cycle and applicable payment authorisation.

You may cancel future renewal through available account controls or by contacting SangmarmarDekho.

Cancellation of renewal normally means that the subscription will not renew for the next billing period.

Your existing subscription may remain active until the end of the already-paid period.

13. Refund Policy

General Rule

Fees paid for digital subscriptions and marketplace services are generally non-refundable once the subscription or service has been activated.

Cancellation of a subscription does not automatically create a refund for the unused portion of the current subscription period.

This includes situations where:

• The seller does not use the Platform;
• The seller removes products;
• The seller receives fewer enquiries than expected;
• The seller does not receive a sale;
• The seller changes its business strategy;
• The seller stops using the Platform.

Refunds may be considered where:

• The same subscription was accidentally charged twice;
• Payment was successfully completed but the purchased service could not be activated because of a technical problem attributable to SangmarmarDekho;
• An incorrect amount was charged due to a billing error;
• Applicable law requires a refund;
• SangmarmarDekho determines that an exceptional refund is appropriate.

Premium / Featured Services

Premium Seller, Featured Seller and promotional visibility fees are generally non-refundable once the service has been activated.

If SangmarmarDekho is unable to provide a purchased promotional service due to a technical issue attributable to us, we may provide an extension, replacement service, account credit or refund, as appropriate.

Refund Requests

Refund requests can be submitted to: info@marbleledgers.com

Please include:

• Name;
• Registered mobile/email;
• Business name;
• Transaction ID;
• Payment date;
• Amount;
• Reason for the request.

Approved refunds will generally be processed to the original payment method, subject to payment-provider and banking timelines.

14. Early Bird and Promotional Pricing

SangmarmarDekho may provide promotional or Early Bird pricing.

Such offers may be:

• Limited by time;
• Limited by seller count;
• Limited to eligible users;
• Available for a specified subscription period.

Unless expressly stated otherwise, promotional pricing does not create a lifetime pricing commitment or additional refund rights.

15. Taxes

Applicable GST and other taxes may be charged as required by law.

Where applicable, tax invoices may be issued based on the information supplied by the customer.

Sellers are independently responsible for their tax obligations relating to transactions with buyers.

16. User Content

Users may upload:

• Company logos;
• Product images;
• Product videos;
• Product descriptions;
• Business information;
• Product catalogues;
• Reviews;
• Other content.

You retain ownership of content that you lawfully own.

By uploading content to SangmarmarDekho, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format, technically modify, distribute and use that content for operating, promoting and improving the Platform.

You confirm that you have the necessary rights to upload such content.

17. Intellectual Property

The SangmarmarDekho name, logo, website, software, design, graphics, database structure, text and other proprietary Platform content are owned by or licensed to SangmarmarDekho.

You may not copy, reproduce, modify, scrape, reverse engineer, distribute or commercially exploit our proprietary content without permission, except where permitted by law.

18. Third-Party Services

SangmarmarDekho may use or integrate third-party services including:

• Razorpay;
• WhatsApp/Meta;
• Google Maps;
• Email providers;
• Analytics providers;
• Hosting/cloud providers;
• Other technology providers.

Third-party services are governed by their own terms and policies.

SangmarmarDekho is not responsible for independent changes, interruptions or failures of third-party services.

19. Account Suspension or Termination

SangmarmarDekho may suspend, restrict, hide or terminate an account or listing where we reasonably believe that the user:

• Violated these Terms;
• Provided false information;
• Uploaded prohibited content;
• Engaged in fraud;
• Manipulated the Platform;
• Misused buyer information;
• Failed verification;
• Created a security risk;
• Violated applicable law;
• Failed to make required payments.

Where appropriate, we may provide notice and an opportunity to resolve the issue.

20. Platform Availability

We aim to maintain a reliable Platform but do not guarantee uninterrupted or error-free operation.

The Platform may temporarily become unavailable because of:

• Maintenance;
• Updates;
• Hosting problems;
• Network failures;
• Security incidents;
• Third-party service interruptions;
• Events outside our reasonable control.

21. Limitation of Liability

To the maximum extent permitted by applicable law, SangmarmarDekho will not be responsible for indirect, incidental, special or consequential losses arising from:

• Buyer-seller transactions;
• Product quality;
• Product defects;
• Delivery;
• Installation;
• Seller conduct;
• Buyer conduct;
• Loss of business;
• Lost profits;
• Third-party services;
• Platform interruption;
• Unauthorised access caused by circumstances outside our reasonable control.

Nothing in these Terms excludes liability that cannot legally be excluded.

22. Indemnification

You agree to indemnify and hold harmless SangmarmarDekho, its owners, employees, officers, contractors and service providers against claims, losses, liabilities and expenses arising from:

• Your violation of these Terms;
• Your content;
• Your products or services;
• Your transactions;
• Your infringement of third-party rights;
• Your unlawful conduct;
• Your violation of applicable law.

23. Changes to the Platform or Terms

We may modify, add or remove Platform features and services from time to time.

We may also update these Terms.

The updated version will be published on the Platform with a revised “Last Updated” date.

24. Governing Law

These Terms shall be governed by the laws of India.

Subject to applicable law, disputes shall be subject to the jurisdiction of the competent courts at: Jaipur, Rajasthan, India.
